Acceptance of these terms

These Terms of Service ("Terms") form an agreement between you and Northpeak Prop ("we", "us", "our"). By accessing this website, purchasing an evaluation, or using a funded account, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy and Risk Disclosure. If you do not agree, do not use our services.

Eligibility

You must be at least 18 years old and have the legal capacity to enter into a contract to use our services. You are responsible for ensuring that your use of our programs is lawful in your country of residence. We may refuse, suspend or terminate access where we reasonably believe participation is prohibited or restricted.

The service we provide

Northpeak Prop provides skill-assessment evaluations and, on successful completion, funded trading accounts that operate in a simulated environment. Orders are not placed in live markets and we are not a broker, exchange, securities dealer or investment adviser. Our programs are for skill-assessment and educational purposes.

We may add, change, suspend or discontinue any part of the service, including programs, pricing, rules and features, at any time. Where changes materially affect an active account, we will use reasonable efforts to give you notice.

Accounts and registration

You agree to provide accurate, current and complete information when registering and to keep it up to date. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly of any unauthorised use. You may hold only one account unless we expressly permit otherwise.

Fees and payment

Evaluation fees are shown at checkout and are payable in full before access is granted. You authorise us and our payment providers to charge the applicable fee. Unless stated otherwise, fees exclude any taxes that may apply to you. Refund eligibility is described in our Refund Policy.

Trading rules

Each evaluation and funded account is subject to trading rules, including profit targets, maximum daily and overall loss limits, leverage limits, and prohibited trading practices. The applicable rules are presented with each program and form part of these Terms. It is your responsibility to read and follow them.

Breaching a rule may result in the immediate failure or termination of the relevant account without refund. We may void results and withhold payouts obtained through prohibited practices, exploitation of errors or simulated-pricing issues, or any form of manipulation.

Payouts

Where you qualify for a payout under the rules of a funded account, we will process it in accordance with the published profit split and payout terms. You are solely responsible for any taxes arising from payouts you receive. We may require identity verification before processing a payout and may withhold payouts connected to a rule breach or suspected fraud.

Acceptable use

You agree not to misuse the service, including by attempting to gain unauthorised access, interfering with its operation, using bots or automated abuse, exploiting bugs or pricing errors, copying or reselling our content, or using the service for any unlawful purpose. We may suspend or terminate accounts that breach this section.

Intellectual property

All content on this website and within our programs — including text, design, graphics, logos and software — is owned by Northpeak Prop or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the service for its intended purpose. You may not reproduce, distribute or create derivative works without our written permission.

Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, error-free or secure, or that any result will be achieved. Nothing we provide is financial, investment, legal or tax advice.

Limitation of liability

To the maximum extent permitted by law, Northpeak Prop and its officers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of the service. Our total aggregate liability for any claim relating to the service will not exceed the amount you paid us for the relevant evaluation in the twelve months before the claim. Nothing in these Terms excludes liability that cannot be excluded by law.

Indemnity

You agree to indemnify and hold us harmless from any claims, losses, liabilities and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the service, or your violation of any law or third-party right.

Suspension and termination

We may suspend or terminate your access at any time if you breach these Terms or the trading rules, if we are required to by law, or to protect the service or other users. You may stop using the service at any time. Sections that by their nature should survive termination — including fees owed, disclaimers, limitation of liability and indemnity — will continue to apply.

Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which we are established, without regard to conflict-of-laws principles. You agree to resolve disputes in the courts of that jurisdiction, except where applicable consumer law gives you the right to bring proceedings elsewhere.

Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the date below and, where appropriate, notify you. Your continued use of the service after changes take effect means you accept the updated Terms.
